RWE US Holdings, LLC (“Company,” “us,” “we,” or “our”) and any affiliated U.S. based RWE entities are committed to protecting the privacy of your Personal Information.  As a business-to-business company, we process limited Personal Information, such as information about our customers’ and partners’ employees and other online visitors that we collect through our website and other interactions and communications.  By using the Service, you agree to the collection and use of information in accordance with this Privacy Policy.

This Privacy Notice does not apply to Personal Information:

• We handle on behalf of and under instructions of our business customers (as their Processor or Service Provider), in which case our customers’ privacy notices apply. We do not control and are not responsible for our customers’ privacy and data collection practices.
• About our current/former employees, applicants, and other individuals who interact with us for employment-related purposes, located at the U.S. Job Applicant Privacy Notice.

Whenever you interact with us on behalf of another individual or entity, such as by referring someone to us, you must obtain their consent (or have the legal authority without consent) to share their Personal Information with us.

Changes: We may update this Privacy Notice from time to time.  Any updated Privacy Notice will be effective when posted.  Please check this Privacy Notice periodically for updates. 

Types of Personal Information We Collect

“Personal Information” or “Personal Data” is any information relating to an identified or identifiable natural person. This includes the following categories, which we may have collected over the last 12 months:

• Identifiers, such as your name, email address, business contact information, and device identifiers (e.g., cookie IDs and IP address)
• Records About You, such as the content, timing and method of communications you have with us, such as online chats, calls, and emails; and other information you may share with us.
• Protected class and demographic information, such as your age (including birthdates) shared with us.
• Commercial information, such as information about the services you may have purchased.
• Internet or other electronic network activity information, such as your browsing history, search history, and information regarding your interactions with and use of our website.
• Non-precise geolocation data, such as your location as derived from your IP address.
• Professional or employment-related information, such as job title, organization, and other professional information.
• Inferences drawn from any of the information we collect, such as likelihood of your profile being a good fit with our internal team and long-term prospects with the Company.  

Sources of Personal Information

We may collect Personal Information about you from the following sources:

• Directly from you. We may collect Personal Information you provide to us directly, such as when you contact us.
• Through automated data collection technologies. We may collect your information using automated data collection technologies as described in the Cookies and Other Data Collection Technologies section below.  For example, we may collect the IP (Internet protocol) address of the device you use to access our website and other browsing information, such as page requests, browser type, operating system, and average time spent on our website.
• From third parties. We may collect Personal Information from third parties, such as service providers, business partners, or other third parties who interact with us. 

We may combine and use information and make inferences from information that we receive from the various sources described in this U.S. Privacy Notice, including third party sources. We also use or disclose the combined information and inferences for the purposes identified below.

How We Use Personal Information

We may use your Personal Information for the following purposes:

• To provide our services to you, such as maintaining our website and making other services available to you, providing and delivering you the services you request, providing customer service, providing updates on our products and services, communicating with you (including soliciting feedback or responding to requests, complaints, and inquiries), and providing similar services or otherwise facilitating your relationship with us.
• For our internal business purposes, such as day-to-day operation of our business, maintaining internal business records, such as accounting, document management and similar activities, enforcing our policies and rules, management reporting and analytics, auditing, and IT security and administration.
• For our internal research and product improvement purposes, such as improving our website or other services; creating new services; debugging and repairing errors with our systems, networks, and equipment; and developing and improving algorithms, artificial intelligence or machine learning tools and models.
• For legal, safety or security reasons, such as complying with legal requirements, processes, or orders; complying with reporting and similar requirements; complying with government inspections and other requests from government or other public authorities; pursuing legal rights and remedies; investigating and responding to claims against the Company and its customers and employees; monitoring and managing equal opportunity programs; screening and conducting background checks (as required or permitted by law); protecting our, your, our customers’, and other individuals’ safety, property or rights; addressing security and health and safety issues (including managing spread of communicable diseases) and malicious, deceptive, fraudulent, or illegal activity; ascertaining your eligibility for work; and receiving legal advice or approval.

For example, we may use Personal Information we collect to personalize advertising to you (including by developing product, brand, or services audiences and identifying you across devices/sites), or to analyze interactions with us or our website.

We may use anonymized, de-identified, or aggregated information for any purpose.

How and to Whom We Disclose Personal Information

When we disclose your Personal Information, we do so pursuant to the business purposes listed above. We may disclose Personal Information to the following limited categories of third parties:

• Affiliates and subsidiaries, including parent entities, corporate affiliates, subsidiaries, business units, and other companies that share common ownership with us.
• Service providers or processors that work on our behalf to provide products and services, such as IT support providers, software service providers, internet service providers, web hosting providers, data analytics providers, and companies that provide business support services, financial administration, or event organization.
• Professional consultants, such as accountants, lawyers, financial advisors, and audit firms.
• Law enforcement, government agencies, and other recipients for legal, security, or safety purposes, such as when we share information to comply with law or legal requirements, to enforce or apply our policies, and to protect ours, our customers’, or third parties’ safety, property or rights.
• To other entities in connection with a corporate transaction, such as if we, or some or all of our assets, are acquired by another entity, including through a sale in connection with bankruptcy or other forms of corporate change, e.g., merger, acquisition, restructuring, strategic initiative, or sale of all or some of our assets.
• Business partners, such as certain companies that operate cookies and other tracking technologies, and social media companies. Where required by law, we will obtain your consent prior to disclosing your Personal Information to our business partners.
• Entities to which you have consented to the disclosure, where consent is required by law.

Cookies and Other Data Collection Technologies

Our website use cookies, pixels, and similar technologies (collectively, “Cookies”) to collect information about you, your device, and how you interact with our website.  This section contains additional information about:

Types of Cookies

We and the third parties that we authorize may use:

• Cookies, which are a type of technology that install a small amount of information on a user’s computer or other device when they visit our website.
• Pixels, web beacons, and tags, which are types of code or transparent graphics that contain a unique identifier.  In addition to the uses described below, these technologies provide information about interactions with our website, (including communications such as email we may send to you) and help us customize our marketing activities.  In contrast to cookies, which are stored on a user's device hard drive, pixels, web beacons, and tags are embedded invisibly on our website.
• Session replay tools, which record your interactions with our website, such as how you move throughout our website and engage with our webforms.  In addition to the uses described below, this information helps us improve our website and identify and fix technical issues visitors may be having with our website.
• Embedded scripts and SDKs, which allow us to build and integrate custom experiences on our website.  Embedded scripts are temporarily downloaded onto your device from our web server, or from a third party with which we work, and are active only while you are connected to our website and are deleted or deactivated thereafter.

We may use both first-party Cookies, which are set by us, and third-party Cookies, which are set by other parties.  Some of the Cookies we use may last solely for your browsing session and are deleted when you close your browser, while others are persistent and stored after you close your browser.

Purposes for Using Cookies

 We and authorized third parties use these technologies for purposes including:

• Strictly necessary, such as determining when you are signed in, determining when your account has been inactive, providing you with privacy disclosures and choices, and for troubleshooting and security purposes (including preventing fraud and malicious behavior);
• Functionality, such as remembering language preferences and pages and products you have viewed in order to enhance and personalize your experience when you visit our website;
• Performance/Analytics, such as analyzing how our websites are used to understand which pages within our website are most popular and how users move around them.  For example, we use Google Analytics to help us improve the user experience.
• Marketing/Advertising, such as conducting advertising and content personalization on our website and those of third parties, tracking activity over time and across properties to develop a profile of your interests and advertise to you based on those interests (“interest-based advertising”), providing you with offers and online content that may be of interest to you, and measuring the effectiveness of advertising campaigns and our communications with you—including identifying how and when you engage with one of our emails.    

Types of Data Collected

These Cookies collect data about you and your device, such as your IP address, location (both approximate and precise) cookie ID, device ID, Ad ID, operating system, device type, device settings and other device information, browser used, browser history, search history, pages viewed, search queries, login information, shopping cart information, and information entered into webforms, and information about how you interact with our website (such as pages on our website that you have viewed).

Disclosures of Data

We may disclose information to third parties or allow third parties to directly collect information using these Cookies on our website, such as social media companies, advertising networks, companies that provide analytics (including providers of ad tracking and reporting services), security providers, and others that help us operate our business and website.

Your Choices

As described in the Rights Concerning Your Information section below, residents of certain states may be able to disable Cookies that constitute a “sale,” “sharing,” or “targeted advertising,” as those terms are defined under applicable laws.  You can opt out of such Cookies by selecting the “Your Privacy Choices” link in the footer of the website and selecting “Reject Optional Cookies.”

In addition, you may be able to control how we use cookies through other mechanisms.  Please be aware that if you disable the use of cookies, the functionality of our website may be negatively impacted, and certain areas or features may not display or work correctly.  If you change computers, devices, or browsers; use multiple computers, devices, or browsers; or delete your cookies, you may need to repeat this process for each computer, device, or browser.

• Interest-Based Advertising.  Some of the third parties we work with participate with the Digital Advertising Alliance (“DAA”).  The DAA provides mechanisms for you to opt out of interest-based advertising performed by participating members at https://youradchoices.com/.  Opting out of interest-based advertising will not opt you out of all advertising, but rather only interest-based advertising from us or our agents or representatives.  If you are using a mobile device, you can manage interest-based ads on your device by adjusting the settings provided by your device manufacturer or the operating system provider: Manage settings on iOS devices; and Manage settings on Android devices.
• Browser Settings.  You can also refuse or delete Cookies using your browser settings.  If you want to disable the use of certain specific Cookies or remove them from your device, you can disable or delete them using your browser settings.  Please be aware that not all Cookies can be deleted through browser settings.  Please refer to your browser’s Help instructions to learn more about how to manage Cookies, or use the following links for instructions for commonly used browsers: Apple Safari; Google Chrome; Microsoft Edge; and Mozilla Firefox. 
• Do Not Track.  Some web browsers and other technologies you may use to access the website may include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your preference to not have data about your online browsing activities monitored and collected over time and across websites.  At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized.  As a result, we do not currently respond to DNT browser signals or similar mechanisms.

Opting Out of Communications

We may communicate with you by email, telephone, or SMS text message about products and services that may be of interest to you. If you have opted in or otherwise qualify to receive these forms of communication, and no longer wish to receive such communications, you may opt out or unsubscribe by following the instructions that are included in the communication or by contacting us using the information provided in the Contact Us section below.

Data Security and Data Retention

We maintain reasonable security procedures and technical and organizational measures to protect your Personal Information against accidental or unlawful destruction, loss, disclosure or use. We also take reasonable steps to ensure that third parties who work with us agree to protect the Personal Information we disclose to them or that they process on our behalf.

We will retain each category of your personal information for as long as necessary to fulfill the purposes described in the How We Use Personal Information section above, unless required to do otherwise by applicable laws. Criteria we will use to determine how long we will retain your information include whether: we need your information to provide you with products or services you have requested; we continue to have a relationship with you; you have requested information, products, or services from us; we have a legal right or obligation to continue to retain your information; we have an obligation to a third party that involves your information; our retention or recordkeeping policies and obligations dictate that we retain your information; we have an interest in providing you with information about our products or services; or we have another business purpose for retaining your information.

Your California Privacy Rights

This section provides additional information for California residents whose information is subject to the California Consumer Privacy Act (“CCPA”).  It does not apply to individuals who are not California residents.

Sources of Personal Information

We have collected Personal Information from the categories of sources detailed in the Sources of Personal Information section above.

Use and Disclosure of Personal Information

We use Personal Information for the business and commercial purposes detailed in the How We Use Personal Information section above.  We disclose all the Personal Information as described in the How and to Whom We Disclose Personal Information section and further described in this section.

Although we do not “sell” Personal Information in the traditional sense, i.e. for money, in the past 12 months, we engaged in many standard business interactions with third parties that might be considered a “sale” or “sharing” of Personal Information as those concepts are defined by the CCPA. We do not knowingly sell or disclose personal information of minors under the age of 16 or share sensitive personal data.

In the preceding 12 months, we may have sold or shared the following categories of Personal Information: identifiers, internet and other electronic network activity information, non-precise geolocation data (e.g., derived from IP address), and inferences to business partners and other companies that operate Cookies on our website. These third parties use the data to allow us to understand how the website is used, to understand your preferences and interests, and to customize advertisements to those interests and preferences. Rights Concerning Your Information

California residents may have certain rights, subject to legal limitations, concerning the collection, use, and disclosure of Personal Information.

• Right to Know. You have the right to request information about the categories of Personal Information we have collected about you, the categories of sources from which we collected the Personal Information, the purposes for collecting, selling, or sharing the Personal Information, and to whom we have disclosed Personal Information and why. You may also request the specific pieces of Personal Information we have collected about you.
• Right to Delete. You have the right to request that we delete Personal Information that we have collected about you.
• Right to Correct. You have the right to request that we correct inaccurate Personal Information that we maintain about you.
• Right to Opt Out of Sale or Sharing.  You have the right to opt out of the sale or sharing of your Personal Information.  You can exercise this right to opt out by selecting the “Your Privacy Choices“ link in the footer of the website and selecting “Reject Optional Cookies.”  

California residents may exercise the Right to Know, the Right to Delete, and the Right to Correct by emailing us at [email protected].

You may also submit a Right to Opt Out of Sale or Sharing request using a preference signal that is sent in a commonly used and recognized format, such as an HTTP header field or JavaScript object.  We will process opt-out preference signals at the browser level.

We will not discriminate against you for exercising your privacy rights.

Verification: In order to process requests, we will need to obtain information to locate you in our records or verify your identity depending on the nature of the request. For Requests to Know, Delete, and Correct, we will collect some or all of the following data elements: first and last name, email address, and telephone number. In some cases, we may request different or additional information, including a signed declaration that you are who you say you are, and will inform you if we need such information.

Authorized Agents: Authorized agents may exercise rights on behalf of California residents by submitting a request via Data Privacy U.S. ([email protected]) and indicating that they are submitting the request as an agent. If you designate an authorized agent to submit a Request to Know, Delete, or Correct, we may seek additional information from the authorized agent or reach out to you directly to verify your identity or to confirm that you provided the authorized agent with permission to submit the request.

Children’s Privacy

We do not knowingly collect personal information from children under the age of 16. If we discover that we have inadvertently collected the information of a minor and are not required to retain it for legal purposes, we will promptly delete it.

Third-Party Websites

Our websites sometimes provide links to websites operated solely by third parties that are not under our control. This U.S. Privacy Notice does not apply to the practices of such third-party websites. Your access and use of such websites is covered by the privacy policies of those third parties.
