RWE Clean Energy, LLC ("Company," "us," "we," or "our") and any affiliated U.S. based RWE entities are committed to protecting the privacy of your Personal Information. This Privacy Notice describes how we process the Personal Information we collect through our website and other interactions and communications you have with us. By using the Service, you agree to the collection and use of information in accordance with this Privacy Policy.
Types of Personal Information We Collect
“Personal Information” or “Personal data” is any information relating to an identified or identifiable natural person. This includes the following categories, which we may have collected over the last 12 months:
- Identifiers, such as your name, email address, business contact information, and device identifiers (e.g., cookie IDs and IP address).
- Records About You, such as the content, timing and method of communications you have with us, such as online chats, calls, and emails; and other information you may share with us.
- Protected class and demographic information, such as your age (including birthdates) shared with us.
- Commercial information, such as information about the services you may have purchased.

- Non-precise geolocation data, such as your location as derived from your IP address.

- Inferences drawn from any of the information we collect, such as likelihood of your profile being a good fit with our internal team and long-term prospects with the Company.
Sources of Personal Information
We may collect Personal Information about you from the following sources:
- Directly from you. We may collect Personal Information you provide to us directly, such as when you contact us.
- Through automated data collection technologies. We may collect your information using automated data collection technologies as described in the Cookies and Other Data Collection Technologies section below. For example, we may collect the IP (Internet protocol) address of the device you use to access our website and other browsing information, such as page requests, browser type, operating system, and average time spent on our website.
- From third parties. We may collect Personal Information from third parties, such as service providers, business partners, or other third parties who interact with us.
We may combine and use information and make inferences from information that we receive from the various sources described in this U.S. Privacy Notice, including third party sources. We also use or disclose the combined information and inferences for the purposes identified below.
How We Use Personal Information
We may use your Personal Information for the following purposes:
- To provide our services to you, such as maintaining our website and making other services available to you, providing and delivering you the services you request, providing customer service; providing updates on our products and services, communicating with you (including soliciting feedback or responding to requests, complaints, and inquiries); and providing similar services or otherwise facilitating your relationship with us.
- For our internal business purposes, such as day-to-day operation of our business, maintaining internal business records, such as accounting, document management and similar activities, enforcing our policies and rules, management reporting and analytics, auditing, and IT security and administration.
- For our internal research and product improvement purposes, such as improving our website or other services, creating new services, and debugging and repairing errors with our systems, networks, and equipment.

- In connection with a corporate transaction, such as if we acquire, or some or all of our assets are acquired by, another entity, including through a sale in connection with bankruptcy and other forms of corporate change.
- For marketing and targeted advertising, such as marketing our products or services or those of our affiliates, business partners, or other third parties. For example, we may use Personal Information we collect to personalize advertising to you (including by developing product, brand, or services audiences and identifying you across devices/sites), or to analyze interactions with us or our website.
We may use anonymized, de-identified, or aggregated information for any purpose.
How and to Whom We Disclose Personal Information
When we disclose your Personal Information, we do so pursuant to the business purposes listed above. We may disclose Personal Information to the following limited categories of third parties:
- Affiliates and subsidiaries, including parent entities, corporate affiliates, subsidiaries, business units, and other companies that share common ownership with us.

- Business partners, such as certain companies that operate cookies and other tracking technologies, and social media companies. Where required by law, we will obtain your consent prior to disclosing your Personal Information to our business partners.
- Entities to which you have consented to the disclosure, where consent is required by law.
Cookies and Other Data Collection Technologies
Our website use cookies. Data Security and Data Retention
We maintain reasonable security procedures and technical and organizational measures to protect your Personal Information against accidental or unlawful destruction, loss, disclosure or use. We also take reasonable steps to ensure that third parties who work with us agree to protect the Personal Information we disclose to them or that they process on our behalf.
We will retain your Personal Information only for as long as necessary to manage our employment relationship with you. We will also retain your Personal Information to the extent required to satisfy our legal obligations.
Your California Privacy Rights
This section provides additional information for California residents whose information is subject to the California Consumer Privacy Act (“CCPA”). It does not apply to individuals who are not California residents.

Use and Disclosure of Personal Information
We have used and disclosed Personal Information for the business and commercial purposes detailed, respectively, in the How We Use Personal Information and How and to Whom We Disclose Personal Information sections above.
Although we do not “sell” personal information in the traditional sense, i.e. for money, in the past 12 months, we engage in many standard business interactions with third parties that under a broad definition might be considered a “sale” or “sharing” of Personal Information as those concepts are defined by CCPA or other comparable U.S. state laws where applicable. We do not knowingly sell or disclose personal information of minors under the age of 16 or share sensitive personal data. We do allow you to exercise your privacy rights (where applicable), as well as direct us to refrain from selling or sharing personal information associated with you in the future, in accordance with California law by allowing you to opt out by emailing Data Privacy U.S. (dpo-americas@rwe.com) or through the any contact provided at Global Data Protection
Specifically, we allow third parties to control the collection of Personal Information through cookies and other tracking technologies. These third parties use the data to allow us to understand how the website is used, to understand your preferences and interests, and to customize advertisements to those interests and preferences. Retention of Personal Information
We will retain each category of your personal information for as long as necessary to fulfill the purposes described in the How We Use Personal Information section above, unless required to do otherwise by applicable laws. Criteria we will use to determine how long we will retain your information include whether: we need your information to provide you with products or services you have requested; we continue to have a relationship with you; you have requested information, products, or services from us; we have a legal right or obligation to continue to retain your information; we have an obligation to a third party that involves your information; our retention or recordkeeping policies and obligations dictate that we retain your information; we have an interest in providing you with information about our products or services; or we have another business purpose for retaining your information.
Rights Concerning Your Information
California residents may have certain rights, subject to legal limitations, concerning the collection, use, and disclosure of Personal Information.
- Right to Know. You have the right to request information about the categories of Personal Information we have collected about you, the categories of sources from which we collected the Personal Information, the purposes for collecting, selling, or sharing the Personal Information, and to whom we have disclosed Personal Information and why. You may also request the specific pieces of Personal Information we have collected about you.
- Right to Delete. You have the right to request that we delete Personal Information that we have collected from you.
- Right to Correct. You have the right to request that we correct inaccurate Personal Information that we maintain about you.
- Right to Opt Out of Sale or Sharing. You have the right to opt out of the sale or sharing of your Personal Information.
- Right to Limit Use and Disclosure of Sensitive Personal Information. You have the right to limit the use and disclosure of Sensitive Personal Information.
We will do our best to honor your requests. However, due to legal limitations, we may have to deny certain requests, such as, for example, a request to delete information in your employment records if we are required by California or federal law to maintain such information.
California residents may exercise the Right to Know, the Right to Delete, the Right to Correct, and the Right to Opt Out of Sale or Sharing by emailing us at DP.rwece@rwe.com.
You may also submit a Right to Opt Out of Sale or Sharing request using a preference signal that is sent in a commonly used and recognized format.
We will not discriminate against you for exercising your privacy rights.
Verification: In order to process requests, we will need to obtain information to locate you in our records or verify your identity depending on the nature of the request. In most cases, we will collect some or all of the following data elements: first and last name, email address, and telephone number. In some cases, we may request different or additional information, including a signed declaration that you are who you say you are, and will inform you if we need such information.
Authorized Agents: Authorized agents may exercise rights on behalf of California residents by submitting a request via Data Privacy U.S. (dpo-americas@rwe.com) and indicating that they are submitting the request as an agent. We will require the agent to demonstrate authority to act on behalf of the resident by providing signed permission from the resident. We may also require the resident to verify their own identity directly with us or to directly confirm with us that they provided the authorized agent permission to submit the request.
Timing: We will process Right to Opt Out of Sale or Sharing and Right to Limit Use and Disclosure of Sensitive Personal Information requests within 15 business days. We will respond to Right to Delete, Right to Correct, and Right to Know requests within 45 days, unless we need more time, in which case we will notify you and may take up to 90 days total to respond to your request.
Sensitive Personal Information
We only use and disclose your Sensitive Personal Information for the following purposes: (i) performing services or providing goods reasonably expected by an average consumer; (ii) detecting security incidents; (iii) resisting malicious, deceptive, or illegal actions; (iv) ensuring the physical safety of individuals; (v) for short-term, transient use, including non-personalized advertising; (vi) performing or providing internal business services; (vii) verifying or maintaining the quality or safety of a service or device; or (viii) for purposes that do not infer characteristics about you.
Other U.S. State Privacy Rights
Certain other states in the U.S. grant privacy rights. Depending on where you live, you may have the following rights, subject to any applicable exemptions of limitations:
- The right to know and access your Personal Information, such as the categories of Personal Information we have collected, the sources of Personal Information, the purposes of collection, and how we used, disclosed, sold, or shared Personal Information;
- The right to correct inaccurate Personal Information that we maintain about you;
- The right to delete your Personal Information under specific circumstances;
- The right to object or opt out of certain types of processing, such as targeted advertising, direct marketing, and certain types of profiling and automated decision-making;
- The right to request the restriction of processing of your Personal Information; and
- The right to data portability, which means requesting a copy of your Personal Information in an accessible format.
To the extent any of the above rights are applicable, you may exercise your rights by contacting us.
We will take steps to verify your identity before processing certain requests. We will not fulfill your request unless you have provided sufficient information for us to reasonably verify you are the individual about whom we collected Personal Information. We may request additional information about you to verify your identity. We will only use the Personal Information provided in the verification process to verify your identity or authority to make a request and to track and document request responses, unless you initially provided the information for another purpose.
You may be able to use an authorized agent to submit a rights request on your behalf. When we verify your agent’s request, we may verify both your and your agent’s identity and request a signed document from you that authorizes your agent to make the request on your behalf. To protect your Personal Information, we reserve the right to deny a request from an agent that does not submit proof that they have been authorized by you to act on their behalf.

Children’s Privacy
We do not knowingly collect personal information from children under the age of 16. If we discover that we have inadvertently collected the information of a minor and are not required to retain it for legal purposes, we will promptly delete it.
Third-Party Websites
Our websites sometimes provide links to websites operated solely by third parties that are not under our control. This U.S. Privacy Notice does not apply to the practices of such third-party websites. Your access and use of such websites is covered by the privacy policies of those third parties.
